Subclass 491 Small Business Owners (QLD) VISAS

This visa, designed for small business owners, allows temporary visa holders who are currently living and lawfully operating a small business in regional Australia to continue living and working in designated regional areas of Australia for up to five years. It is also a points-based visa, and you are required to be nominated by the Queensland (QLD) government.

Subclass 491 Small Business Owners (QLD)

To be eligible for the visa, you must meet the Department of Home Affairs (DOHA) requirements:

  • Be under 45 years of age
  • Nominate an eligible skilled occupation 
  • Have a positive skills assessment
  • Have competent English
  • Score at least 65 points 
  • Be nominated by QLD government
  • Meet health and character requirments 

In addition to the QLD requirements, there are two pathways:

For both pathways, you must:

  • Have 100% ownership of the relationship
  • Have operated the business and live in regional QLD 
  • Have a full-time work right

Pathway 1 

  • The business must have been operating for a minimum of two years in its current location, immediately prior to purchase.
  • The purchasing price of the existing business is minimum of $100,000
  • Operate the business for at least 6 months
  • Employ at least one Australian resident

Pathway 2 

  • Have been operating a profitable start-up for a minimum of two years, with a turnover of $200,000 in the twelve months prior to application

Length of stay:  up to 5 years

Processing time: 16 months more

Application preparation time: 6 months to 1 year

The Business Innovation and Investment Visa (subclass 188) BIIP,  is a category of visa offered by the Australian government to encourage business owners, investors, and entrepreneurs to contribute to the Australian economy. It is part of the Business Innovation and Investment Program and is divided into several streams, each catering to specific business and investment activities. Business Innovation Stream

Business Innovation Stream: This stream is for individuals with business skills who want to establish, develop, or manage a new or existing business in Australia.

To be eligible for the visa, you must meet the Department of Home Affairs (DOHA) requirements:

  • Meet the points test (at least 65) for this visa
  • Receive invitation from the state government
  • Have business ownership – AUD 750,000 turnover in each of those 2 years if you were invited to apply 
  • Own personal and business assets – AUD 1.25 million 
  • Have a successful business career
  • Be under 55
  • Have functional English 
  • Meet the health and character requirements stream.

If granted, you will be able to travel to, enter and remain in Australia for up to 7 years after the date of the grant of the original Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation stream until you are eligible to apply for Subclass 888 in Business Innovation stream.

Processing time: 38 months more
Length of stay: Up to 5-9 years 
Application preparation time: 6 months to 1 year

If you need more time to apply for permanent residence, you can apply for a new Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation Extension.

Significant Investor Stream

This temporary visa is intended for individuals who commit a minimum of AUD $5 million to Australian investments that align with specific criteria and continue their investment activities in Australia.

To be eligible for the visa, you must meet the Department of Home Affairs (DOHA) requirements:

  • Meet the points test (at least 65) for this visa
  • Receive invitation from the state government
  • Be able to invest at least AU$5 million 
  • Have functional English (can be exempt)
  • Meet the health and character requirements

If granted, you will be able to travel to, enter and remain in Australia for up to 7 years after the date of the grant of the original  Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor Extension stream. Some circumstances can be granted up to 9 years until you are eligible to apply for Subclass 888 in the Significant Investor stream.

Length of stay: Up to 7 years 

Application preparation time: 6 months to 1 year
